By accessing or using this website or any services provided by CommonPoint LLC (“CommonPoint,” “we,” “our,” or “us”), you agree to these Terms of Service. If you are using the services on behalf of an organization, you represent and warrant that you have the authority to bind that organization.
If you do not agree to these terms, you may not use the services.
CommonPoint LLC provides two distinct categories of services:
Strategy, consulting, messaging, content, and advisory services delivered directly by CommonPoint to clients.
A technology platform that enables organizations to conduct consent-based voice surveys or polling to collect feedback from participants.
The obligations and responsibilities associated with each service differ and are described below.
You must be at least 18 years old and legally capable of entering into a binding agreement to use the services.
Professional marketing services are provided on a consulting and advisory basis only.
CommonPoint LLC:
Does not send automated calls or messages as part of its marketing services
Does not act as a telemarketing firm or outbound calling service
Does not provide, purchase, or manage contact lists unless explicitly agreed in writing
Clients are solely responsible for how recommendations are implemented and for ensuring compliance with applicable laws and regulations.
When using the survey platform, you are solely responsible for:
• Survey content
• Recipient selection
• Message timing and frequency
• Compliance with all applicable laws and regulations
CommonPoint provides the technology platform only and does not determine recipients, initiate SMS messages, or control how surveys are conducted.
You agree not to use any CommonPoint service to:
• Send SMS messages without proper consent
• Harass, deceive, or mislead recipients
• Use the survey platform for marketing, advertising, or promotional outreach
• Violate applicable privacy, consumer protection, or telephony laws
• Engage in fraudulent, abusive, or unlawful activity
You are responsible for obtaining and maintaining all legally required consent before sending SMS messages or collecting survey responses using the platform.
You agree to comply with all applicable laws and regulations, including but not limited to:
• The Telephone Consumer Protection Act (TCPA)
• State and federal privacy and consumer protection laws
• Carrier and industry guidelines governing SMS communications
CommonPoint does not provide consent on your behalf and does not independently verify recipient consent.
The survey platform does not store or retain audio recordings.
Voice input is collected only when a participant voluntarily speaks into their device microphone within the survey interface. Audio is processed in real time to generate transcriptions and is not saved after transcription is completed.
Transcribed responses may be stored as survey results for reporting and analysis.
For voice survey and polling services, CommonPoint LLC acts solely as a technology provider and is not the sender or originator of calls initiated by users.
Users control survey content, recipients, and delivery parameters and are responsible for all communications sent using the platform.
We reserve the right to suspend or terminate access to any service if we believe it is being used:
In violation of these Terms
In violation of applicable laws or regulations
In a manner that creates legal, regulatory, or compliance risk
Services are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.
To the fullest extent permitted by law, CommonPoint LLC will not be liable for any indirect, incidental, consequential, or special damages arising from or related to use of the services.
These Terms of Service are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
