1. Acceptance of These Terms

By accessing or using this website or any services provided by CommonPoint LLC, you agree to these Terms of Service. If you are using the services on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree, do not use the services.

2. Our Services

CommonPoint LLC provides two primary categories of services:

  1. Professional Marketing Services
    Strategy, consulting, messaging, content, and advisory services delivered directly by CommonPoint to clients.

  2. Voice Survey Software
    A technology platform that enables organizations to collect feedback from participants through automated voice surveys and related communications.

The obligations and responsibilities related to each service differ, as described below.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use our services.

4. Professional Marketing Services

Marketing services are provided on a consulting and advisory basis.
CommonPoint LLC:

  • Does not send automated calls or messages on behalf of clients as part of marketing services
  • Does not act as a telemarketing firm
  • Does not provide or manage contact lists unless explicitly agreed in writing


Clients are responsible for how recommendations are implemented and for compliance with applicable laws.

5. Voice Survey Software Responsibilities

When using the voice survey software, you are solely responsible for:

  • Survey content
  • Recipient selection
  • Call timing and frequency
  • Compliance with all applicable laws and regulations


CommonPoint LLC provides the technology platform only and does not control or initiate survey communications.

6. Acceptable Use

You agree not to use any CommonPoint service to:

  • Place calls or send messages without proper consent
  • Harass, deceive, or mislead recipients
  • Violate applicable privacy, consumer protection, or telephony laws
  • Engage in fraudulent or abusive behavior

7. Consent and Regulatory Compliance

You are responsible for obtaining and maintaining all legally required consent before initiating any calls or messages using the voice survey platform.

You agree to comply with all applicable laws and regulations, including but not limited to:

  • The Telephone Consumer Protection Act (TCPA)
  • State and federal telephony and privacy laws
  • Industry guidelines governing automated communications

CommonPoint LLC does not provide consent on your behalf and does not verify recipient consent. 

8. Messaging and Calling Disclaimer

For voice survey services, CommonPoint LLC acts solely as a technology provider and is not the sender or originator of calls or messages initiated by users.

Users control survey content, recipients, and delivery.

9. Suspension and Termination

We reserve the right to suspend or terminate access to any service if we believe it is being used in violation of these terms, applicable laws, or in a manner that creates regulatory or compliance risk.

10. Service Availability

Services are provided “as is.” We do not guarantee uninterrupted or error-free operation.

11. Limitation of Liability

To the fullest extent permitted by law, CommonPoint LLC will not be liable for indirect, incidental, or consequential damages arising from use of the services.

12. Governing Law

These terms are governed by the laws of the State of [State], without regard to conflict-of-law principles.
